Dr. Jilla Weinberg, author of “Consensual Violence: Sex, Sport, and the Politics of Injury,” published “Demons from the Bin” in the US. And despite the consent of the other partner at the time, one BDSM partner pleaded guilty in several lawsuits.

Weinberg”s book examines two very different activities that are consensual but potentially violent: mixed martial arts and BDSM. In both cases, people agree to participate in something that could result in injury. However, these activities are treated differently under the law. In the case of mixed martial arts, participants are not subject to criminal prosecution, but in the case of BDSM, things are quite different.

According to US law, “a person cannot consent to injury to health because it is contrary to public order.” However, there is an exception that applies to participation in lawful sporting events. In other words, we have a clear exception for sports, but no such exception for injuries that may result from consensual sexual relations.

As a result, a number of BDSM-related cases have gone to court, and Weinberg writes: “And this despite the fact that in martial arts, participants don”t stop and ask each other about preferences. BDSM practitioners set “strict boundaries” for each other. Therefore, Weinberg argues that we have once again found ourselves in a situation of double standards.
